Cascade Healthcare Solutions Terms and Conditions of Sale

BY ACCEPTING DELIVERY OF THE PRODUCTS AND SERVICES DESCRIBED IN YOUR ORDER INVOICE OR OTHER CASCADE HEALTHCARE SOLUTIONS DOCUMENTATION, THE CUSTOMER AGREES TO BE BOUND BY AND ACCEPTS THESE TERMS AND CONDITIONS OF SALE UNLESS THE CUSTOMER AND CASCADE HEALTHCARE SOLUTIONS HAVE SIGNED A SEPARATE AGREEMENT, IN WHICH CASE THE SEPARATE AGREEMENT WILL GOVERN.

The terms and conditions of sale bind the customer and Cascade Healthcare Solutions. The customer accepts the terms and conditions when making a purchase from the Cascade Healthcare Solutions website or over the phone.

Warranties

CASCADE HEALTHCARE SOLUTIONS HEREBY EXPRESSLY DISCLAIM ALL WARRANTIES EITHER EXPRESSED OR IMPLIED, RELATING TO PRODUCTS SOLD BY CASCADE HEALTHCARE SOLUTIONS, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR WARRANTY OF NON-INFRINGEMENT. THIS DISCLAIMER DOES NOT AFFECT THE TERMS OF THE MANUFACTURER'S WARRANTY.

The customer understands that Cascade Healthcare Solutions is not the manufacturer of the products purchased by the customer. The only warranties offered are those of the manufacturer, not Cascade Healthcare Solutions. In purchasing the products, the customer is relying on the manufacturer's specifications only and is not relying on any specifications, statements, photographs or other illustrations representing the products that may be provided by Cascade Healthcare Solutions. The title to the goods purchased from Cascade Healthcare Solutions is retained by the seller until the goods are paid for, in full, by the customer. Once the goods have been paid for in full, the title then passes to the customer.

Limitation of Liability

CASCADE HEALTHCARE SOLUTIONS WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR ANY CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTIES. CASCADE HEALTHCARE SOLUTIONS WILL NOT BE LIABLE FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR LOST.

Cascade Healthcare Solutions will not be responsible for any delays in delivery which result from any circumstances beyond its control, including without limitation, product unavailability, carrier delays, severe weather conditions, delays due to fire, failure of power, acts of war, terrorism, labor problems, general insurrection, acts of God or acts of any government or agency. Anticipated delivery dates are based upon manufacturer supplied information and are subject to change, therefore any shipping dates provided by Cascade Healthcare Solutions are estimates only.

Pricing

Pricing is subject to change. Cascade Healthcare Solutions reserves the right to make adjustments to pricing, products and service offerings for reasons including, but not limited to product discontinuation, changing market conditions, product unavailability, errors in advertisements and manufacturer price changes. All orders are subject to product availability, therefore Cascade Healthcare Solutions cannot guarantee that it will be able to fulfill customer orders.

Governing Law

THESE TERMS AND CONDITIONS OF SALE AND ANY SALE HEREUNDER WILL BE GOVERNED BY THE LAWS OF THE STATE OF WASHINGTON, WITHOUT REGARD TO CONFLICTS OF LAWS RULES. ANY ARBITRATION, ENFORCEMENT OF ANY ARBITRATION OR LITIGATION WILL BE BROUGHT IN KING COUNTY, WASHINGTON AND CUSTOMER CONSENTS AND SUBMITS TO THE JURISDICTION OF THE FEDERAL AND STATE COURTS LOCATED IN KING COUNTY, WASHINGTON AND THEREFORE WAIVES THE RIGHT TO CHANGE VENUE.

Payment Options

Payment by an American Express, MasterCard, Discover, or Visa credit card is accepted with no surcharge. Your credit card is not charged until your order has shipped. Applicable sales tax will be added to Washington State orders.

Return Policy

All products are covered by manufacturer's warranty against defects. Certain manufacturers require you to contact those manufacturers directly to repair or replace your products under their warranty.

If the manufacturer's factory seal is intact you may return an unopened product for exchange or refund within 30 days from the invoice date. The return may be subject to a restocking fee depending on the circumstances. If you would like further information on a return for a specific product please contact our returns department. Authorized returns will be subject to a minimum 15% restock fee. All return requests must be made within 30 days of receiving the product.

No returns will be accepted without a Return Authorization (RA) Number. A Return Authorization Number may be requested up to 30 days from the invoice date. After 30 days from your invoice date, you are required to contact the manufacturers directly to repair or replace their product.

All products must be received by our Returns Processing Center within 10 days of receiving a Return Authorization Number. Items received after 10 days will be refused.

All RA numbers must appear on the shipping label(s) we provide. All items must be returned with original packaging, including all warranty cards, manuals, accessories, components, etc. PLEASE DO NOT MARK ON THE OUTSIDE OF THE BOX. We encourage customers to use a trackable shipping method when returning product.

Replacement product orders will not be shipped until the original item is received and inspected. Once the item has been confirmed defective, the replacement will be shipped. If the defective item is being returned for credit, the credit will not be issued until the item has been inspected and confirmed defective. We can however, ship new product with a secure payment and issue credit once the returned product has been processed.

Shipping and handling charges are not refundable. The customer is responsible for all shipping charges and insurance on all return shipments.

Certain products, if opened or used, are not eligible for return due to hygiene issues. Non-Returnable items include: Bath Safety Products, PVC Medical Equipment, Beds, Mattresses, Patient Lifts, Motorized Wheelchairs, Wheelchair Cushions, Incontinence Products, Recliner Chairs, Lift Chairs, and Some Medical Supplies. For these products, no refunds or exchanges can be made at any time due to manufacturer's return policies. Please call (877) 480-3028 with questions about returns and manufacturer warranties.

For international orders, customers have 30 days to report any problems or defects with the product/s that they received. If the product needs to be fixed, replaced or returned within the first 30 days of receiving the product then Cascade Healthcare Solutions is only responsible for shipping the new or fixed product back to the customer and is not responsible to pay for return shipping costs. Past 30 days it is up to the customer to pay for shipping the product both ways if the product needs to be fixed, replaced, or returned.


PLEASE NOTE: Any deviation from the return policy outlined above will result in a delay of your refund, additional restocking fees, or refusal of your return.
